These terms apply to your use of tribeaura.com.au and to everything you buy from us. Please read them before ordering — placing an order means you accept them.

1. Who we are

This website is operated by Tribe Aura, [legal entity name], ABN [ABN to be supplied], of [registered address], Victoria, Australia. In these terms “we”, “us” and “our” mean Tribe Aura, and “you” means the person using the site or placing an order.

2. Using this site

You may browse and buy for your own personal, non-commercial use. You agree not to interfere with the site, attempt to gain unauthorised access to it, or use it for anything unlawful.

We try to keep product descriptions, prices and availability accurate, but we do not warrant that everything on the site is free of errors. We may correct errors and update information at any time.

3. Orders

An order you place is an offer to buy. No contract exists until we send you an order confirmation. We may decline an order — for example if the item is no longer available, if there has been a pricing or description error, or if we cannot verify your payment or delivery details. If we decline after you have paid, we will refund you in full.

Because our pieces are handmade in small runs, an item can sell out between you adding it to your cart and completing checkout. If that happens we will contact you and refund you.

4. Prices and payment

All prices are in Australian dollars and include GST where GST applies. The price you see at checkout, including any shipping, is the amount you will be charged — we do not add surcharges afterwards.

Payment is taken when you confirm your order. We do not store your full card details; payments are handled by our payment provider.

5. Shipping, delivery and risk

Australian orders over A$150 ship free. Otherwise shipping is calculated at checkout from your postcode. Orders are dispatched within two business days and sent tracked.

Delivery timeframes are estimates, not guarantees, and depend on the carrier. Risk in the goods passes to you on delivery.

Please make sure your delivery address is correct. We cannot redirect a parcel once it is with the carrier, and we are not responsible for loss caused by an address you gave us incorrectly.

6. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits, excludes or modifies those guarantees, and if anything here conflicts with them, the Australian Consumer Law prevails.

In summary, you are entitled to:

• a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage; and
• to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Where the failure is minor, we may choose to repair, replace or refund. Where it is major, the choice is yours.

These rights apply in addition to our returns policy below, not instead of it.

7. Returns, refunds and exchanges

Separately from your Australian Consumer Law rights, we accept change-of-mind returns within 30 days of delivery, provided the item is unworn, unused and in its original packaging. Return postage for a change of mind is at your cost, and we recommend a tracked service — until the parcel reaches us it remains your responsibility.

Contact us before returning anything so we can confirm the return address. Refunds are made to the original payment method once the item has been received and checked.

If an item arrives damaged, faulty, or is not what you ordered, tell us and we will cover return postage and make it right.

8. Handmade goods and natural variation

Every piece we sell is made by hand. Variations in colour, finish, weight, grain and dimensions are characteristic of the craft and are not faults. Natural dyes in particular settle differently from batch to batch, and screen colours vary between devices.

We describe each piece as accurately as we can. This clause does not affect your rights under the Australian Consumer Law, including your right to goods of acceptable quality and goods matching their description.

9. Intellectual property

All content on this site — text, photography, graphics, the Tribe Aura name and logo — is owned by us or used with permission, and is protected by copyright and trade mark law. You may not reproduce, distribute or use it commercially without our written permission.

10. Our liability

Subject to clause 6, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this site or from goods purchased through it. Where liability cannot be excluded but can be limited, our liability is limited (at our option) to resupplying the goods or paying the cost of resupply.

Nothing in this clause limits your rights under the Australian Consumer Law.

11. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these terms.

12. Changes to these terms

We may update these terms from time to time. The version in force is the one published on this page when you place your order, so please check it each time you buy.

13. Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
